Apologies for Absence

Minutes:

Apologies for absence had been received from Councillors R Sweeting, M McCartney, J Cattanach, D Brook and S Duckett.  Councillor D Buckle was in attendance as a substitute for Councillor Sweeting.

 

39.

Disclosures of Interest

A copy of the Register of Interest for each Selby District Councillor is available for inspection at www.selby.gov.uk.

 

Councillors should declare to the meeting any disclosable pecuniary interest in any item of business on this agenda which is not already entered in their Register of Interests. Councillors should leave the meeting and take no further part in the consideration, discussion or vote on any matter in which they have a disclosable pecuniary interest.

 

Councillors should also declare any other interests. Having made the declaration, provided the other interest is not a disclosable pecuniary interest, the Councillor may stay in the meeting, speak and vote on that item of business.

 

If in doubt, Councillors are advised to seek advice from the Monitoring Officer.

Chair's Address to the Licensing Committee

Private Session

That, in accordance with Section 100(A) (4) of the Local Government Act 1972, in view of the nature of the business to be transacted, the meeting be not open to the Press and public during discussion of the following items as there will be disclosure of exempt information as defined in paragraph 3 of Schedule 12(A) of the Act.

Minutes:

It was proposed, and seconded, that the Committee sit in private session due to the nature of the business to be transacted.

 

RESOLVED:

That, in accordance with Section 100(A)(4) of the Local Government Act 1972, in view of the nature of the business to be transacted the meeting be not open to the press and public during discussion of the following items as there will be disclosure of exempt information as described in paragraph 3 of Schedule 12(A) of the Act.

Application for a Hackney Carriage and Private Hire Drivers Licence

To receive the report, which asks the Committee to consider the application for a Hackney Carriage and Private Hire Drivers Licence.

The Solicitor informed the applicant’s representative, who was present remotely, that the Committee had read and considered the additional information that had been provided that morning. 

 

The applicant’s representative confirmed that the applicant would not be joining the meeting and that the applicant was content for his representative to speak on his behalf. 

 

The Licensing Manager presented the report, which asked the Committee to determine an application for a Hackney Carriage Driver’s Licence and a Private Hire Driver’s Licence.  It was noted that the application had been brought before the Committee due to a Disclosure and Barring Service (DBS) check highlighted previous convictions during the application process.

 

The applicant’s representative was able to respond to questions asked by the Committee concerning the report and the previous convictions.

 

The applicant’s representative and the Licensing Manager left the meeting at this point and did not return.

 

The Committee considered the information provided by the applicant’s representative, and in writing and agreed that the evidence presented demonstrated that the applicant was a ‘fit and proper person’ to be a licensed Hackney Carriage and Private Hire driver and agreed that the licenses should be granted.

 

RESOLVED:

To grant the application for a Hackney Carriage Driver’s Licence and a Private Hire Driver’s Licence.

 

Reason for Decision:

 

The Committee was satisfied that the applicant was a ‘fit and proper’ person in accordance with the Council’s Licensing Policy.
